Temporary unemployment due to force majeure 2022: officially treated as days actually worked for annual leave 2023

As announced in a previous Infoflash, the government has come to an agreement: for the calculation of the holiday pay and holiday duration for 2023, the days of temporary unemployment due to force majeure in the first six months of 2022 will be treated as days actually worked.

The Royal Decree to implement that decision has been published in the Belgian Official Gazette.

Note that a compensation mechanism has been introduced for employers employing non-manual workers.  We describe the terms and conditions in an infoflash dedicated to this subject.

 

Source: Royal Decree of 24 May 2023 aiming to assimilate, in the system of annual leave for salaried workers, the days of interruption of work resulting from temporary unemployment due to force majeure following the pandemic caused by the coronavirus, following the consequences of the exceptional climatic conditions of 14 and 15 July 2021 and following the conflict in Ukraine for the period from 1 January 2022 to 30 June 2022 ( Belgian Official Gazette of 9 June 2023).
