Due to a change in the position of the FPS Work and the NSSO, non-manual workers in the removal sector would no longer fall under JC 226 but would move to JC 200. This problem has now been solved.
As an employer in the removal sector, 2 different JCs are competent for your employees:
However, the FPS Work and the NSSO hold a different position on this, as a result of which non-manual workers in the removal sector suddenly would come under the competence of JC 200 (auxiliary JC for non-manual workers). As a result of this change of JC, the pay and employment conditions of your non-manual workers would also change. In order to avoid that the non-manual workers of the removal sector would come under the competence of JC 200, the social partners of JC 226 requested that the scope of this JC be extended to companies performing removal activities on behalf of third parties.
Based on the Royal Decree of 12 May 2021, it is now definitively confirmed that JC 226 is also competent for companies carrying out removal activities on behalf of third parties and therefore nothing changes for your non-manual workers.
