Which provisions apply to your employees' pensions?

Is one of your employees entering retirement? Nothing to worry about, so long as you respect the provisions of the pension.

Employee pension conditions

You grant a retirement pension to employees who:

  • performed business activities as blue- or white-collar workers, and have employment contracts with you as a Belgian employer;
  • have a status that is equivalent to that of an employee: involuntary unemployment, illness, maternity leave, career break, time credit, etc.

Provisions surrounding the retirement age

The statutory retirement age is 65. Is your employee 65 and living in Belgium? Then the granting of the pension is a given. But what if your employee would like to end their career before the retirement age? Then you can propose a different pension system:

  • Unemployment with a company supplement (pre-retirement pension), which implies dismissal;
  • the early-retirement pension: from the age of 61, if your employee has worked for 39 years; from the age of 60 if they have worked 40 years.*
