Temporary measures for employers in difficulty as a result of Brexit: the date of entry into force is known!

A Royal Decree recently published in the Belgian Official Gazette sets the date of entry into force of the temporary crisis measures in favour of employers facing economic difficulties following the withdrawal of the United Kingdom from the European Union (Brexit).

These measures will apply from 22 March 2021 to 21 March 2022.

Which employers are concerned?

These temporary crisis measures apply to private sector employers who are experiencing economic difficulties due to Brexit.

More specifically, these are employers who are recognised by the Minister of Work as being affected by a reduction of at least 5% in their turnover, production or orders as a result of the withdrawal of the United Kingdom from the European Union.

What are the temporary measures?

The temporary crisis measures available to employers facing economic difficulties as a result of Brexit are as follows:

  • temporary unemployment for economic reasons Brexit,
  • time credit Brexit,
  • collective reduction of working hours Brexit.

What conditions must be fulfilled?

To be able to benefit from the temporary crisis measures, the employer must, in certain cases, be bound by a collective labour agreement and submit a request for recognition as an employer in difficulty to the FPS Employment, Labour and Social Dialogue.

Effective date

These measures will be effective from 22 March 2021 to 21 March 2022.
