Night work: additional employer allowance on top of employment benefits

The CBA 46 signed on 23 March 1990 within the National Labour Council determines the wage and working conditions of the employees who usually work between 20 pm and 6 am.

This CBA establishes for some employee categories that they can return temporarily or permanently to another working regime that is not meant by the CBA 46.

It says more in particular that an employee of at least 55 years with a professional seniority of at least 20 years in a working regime with night work, is allowed to ask to be employed under another working regime without night work.

In the case of serious reasons recognized by the occupational health doctor this right is also granted to employees of at least 50 years with a professional seniority of at least 20 years in one of these working regimes.

The employee who requests for another working regime must submit his application according to a specific procedure.

When the employer is not able to provide another work to the employee and, due to this fact, the employment contract is ended (by the employer or the employee), the employee is entitled to an additional allowance on top of his unemployment benefits during a period of 5 years.

Since 1 January 2018 this additional allowance amounts to €144.01/month.
