JC 124: draft agreement in the construction sector

A draft protocol agreement was concluded in JC 124 for the construction sector during the night of 8-9 November. This draft agreement is still to be submitted to the employees' organisations, but we would like to share the main points with you.

Based on this agreement, you should take into account a salary increase of 0.4% and the possibility of granting a corona premium.

Provisions with an impact on salaries

Increase of wages by 0.4% from 1 December 2021.

Award of additional one-off eco vouchers of 130 (by 15/12/2021).

A corona premium of €300 is awarded if the employee worked at least 1 day in the second quarter of 2020 and is still employed on 15/12/2021.

The corona premium can be limited to €150 if the company has made a loss.

Please note: If you award a corona premium to your employees, please inform your Payroll Consultant in advance. Indeed, a special employer's contribution of 16.5% must be paid on this corona premium (under certain conditions) and it must be mentioned on the individual account and on the pay slip of the employee.

Supplementary pension

Increase in supplementary pension from 01/01/2023:

  • from 0.25% to 1.1% if you have 0 to 4 legitimation cards.
  • from 0.45% to 1.1% if you have 5 to 9 legitimation cards.

End-of-career

An end-of-career job is provided from 55 years of age for 1/5th and half time and this until 30/06/2023.

All existing RCC/SWT systems will be extended until 30/06/2023;

Introduction of a medical RCC/SWT until 30/06/2023: 58 years of age, 35 years of professional history and serious physical problem.

Subsistence security

Some allowances will be increased:

  • Permanent incapacity for work of more than 66%:
    • One-off allowance: from €750 to €800.
    • Additional allowance per dependent child: from €600 to €650.
  • Fatal industrial accident:
    • Compensation for widow(er): from €6,000 to €6,350.
    • Additional compensation per dependent child: from €920 to €1,000.
  • Annual compensation for orphans: from €920 to €1,000.
  • Holiday allowance disabled persons: from €540 to €575.

Training

  • Increase in allowance for winter training from €40 to €55 per day.
  • Increase in allowance for Saturday training from €50 to €55 per day.
  • Increase in allowance for evening training to €10 per hour.

Various topics

  • Social dumping:
    • Safety training: Compulsory VCA certificate for all persons working on a site with a safety coordinator. For other sites: a compulsory safety package must be followed.
    • Thoroughly investigate the issue of safety obligations for the self-employed as well.
    • Evaluation of previous agreements to combat social dumping.
  • Research to modernise job classification and pay supplements
  • Asbestos
    • Asbestos removers:
      • increase from category II to IIA after 1 year if basic training and 2 positive evaluations based on a standard sector form.
      • Increase from category IIA to III after 2 years and after positive evaluation based on a standard sector form.
    • Asbestos processors: same pay conditions as asbestos removers.
