Cla 90 wage bonus: new model documents from 1 january 2019

The CLA 90 wage bonus is very popular: more than 700,000 employees and 640 million euros in 2017. From 1 January 2019, new model documents will apply. Please take this into account when drawing up a new accession deed or CLA. The electronic procedure is not yet active.

NEW MODEL DOCUMENTS

The wage bonus has a relatively strict procedure in which the model documents play a central role. The employer must deposit the accession deed and the CLA with the registrar of the General Directorate for Collective Labour Relations of the FPS Work.

The paper version of these mandatory forms changes slightly.

  • The changes particularly relate to the period of validity of the wage bonus plan: the date of entry into force and the end date are neatly distinguished.
  • Also new is the statement that the company has not initiated an information and consultation procedure with regard to collective redundancies with closure of the company. In that case an employer has not been able to grant a fiscally and socially favourable CLA 90 wage bonus since 1 January 2018.

All CLAs and accession deeds signed as from 1 January 2019 must be drawn up in accordance with the new model.

CHANGING OBJECTIVES

The accession deed may provide for a procedure for modifying the levels to be achieved for each objective. The CLA may modify the objectives and the levels.

Such changes may only concern the future. So they cannot relate to a reference period that is still running or that has already expired. This is to avoid that objectives or levels should be changed if it becomes clear that they will not be attained.

The changes must be filed with the registrar before the start of the new reference period.

GOOD PLANNING IS IMPORTANT

If the reference period of the wage bonus plan runs from January to December 2019, the plan must be deposited with the FPS Work by 30 April 2019 at the latest.

GETTING STARTED

Avoid a copy paste of last time. Not only because the compulsory model changes, but also because the FPS Work will certainly be able to monitor more effectively in the future.
