To determine whether the remuneration policy in their company is gender-neutral, certain employers must carry out a detailed analysis of the workers' remuneration structure.

Employers concerned

Companies usually employing at least 50 workers on average are subject to the obligation to draw up an analysis report on the workers' remuneration structure.

Reminder! In order to determine the average number of workers employed in the company, the calculation procedures used for the social elections must be applied.

Full or short form?

The analysis report on the workers' remuneration structure is drawn up on the basis of:

  • a full form when the employer usually employs at least 100 workers on average,
  • a short form when the employer usually employs at least 50 workers but less than 100 workers on average.

Time limits?

Every 2 years, the employers concerned must present the analysis report on the workers' remuneration structure to the works council or, where no such council exists, to the union delegation.

This report will be provided and discussed in the 3 months following the end of the year of service. It will be sent at least 15 days before the meeting that is held to examine it.

Reminder! The 1st analysis report relates to the financial year closed in 2014.
