New procedure for payment of rest days in lieu in the construction sector (JC 124)!

Until last year, payment of rest days in lieu in the construction sector was in principle based on a certificate the employer provided to the manual worker. However, if the manual worker was no longer employed, he received the certificate through Constructiv.

The manual worker then delivered this certificate to his trade union or the PDOK (Patronale Dienst voor Organisatie en Kontrole van de Bestaanszekerheidsstelsels/'Employers' Service for the Organisation and Control of Subsistence Security Systems'), which paid the allowance for the rest days in lieu.

However, this procedure has changed significantly from 2024 onwards.

Procedure as of 2024

The procedure for payment of rest days in lieu in the construction sector varies depending on whether or not the manual worker is a member of a trade union.

  1. The manual worker is a trade union member

If the manual worker is a member of a trade union, this union will pay an allowance for rest days in lieu into his bank account around 12 December 2024.

Therefore, the manual worker will no longer receive a certificate and consequently does not have to contact the trade union.

Please note that if the trade union does not have sufficient information, the manual worker will still receive a certificate, which he must submit to the trade union.

  1. The manual worker is not a trade union member

On the other hand, manual workers who are no trade union members will still receive a certificate. This certificate will be sent directly to the manual workers on 5 December 2024. 

The manual worker must submit this certificate to the PDOK, which will then pay the allowance for the rest days in lieu.

In both of the situations mentioned above, the employer will no longer receive certificates. He will, however, receive a one-time overview listing the manual workers entitled to an allowance for rest days in lieu.
