Flexi-jobs: opt-out in JC 320 and opt-in in JC 139 from 1 July 2024

Context 

On 19 February 2024, Joint Committee 320 concluded a collective agreement requesting to be excluded from the scope of flexi-jobs. 

On 18 March 2024, Joint Committee 139 concluded a collective agreement requesting to be included in the scope of flexi-jobs.

The two joint committees' request had yet to be laid down in a Royal Decree.

This Royal Decree was published on 26 June 2024 and will enter into force on 1 July 2024. 

Opt-out and opt-in 

From 1 July 2024:

  • flexi-jobs will no longer be possible in Joint Committee 320 (undertakers); this is a partial exclusion: the flexi-job system will only apply to casual workers.
  • employers who come under Joint Committee 139 (inland waterway transport) will be able to make use of flexi-jobs.

Moreover, since the first quarter of 2024, the NSSO (National Social Security Office) has been publishing an EXCEL file titled "Champ d’application flexi-jobs" (Scope of flexi-jobs) every quarter on the Social Security Portal: https://www.socialsecurity.be/site_fr/employer/applics/dmfa/index.htm.
