Time credit: reassessment of the definition of a disabled child

In future, workers will be able to benefit more easily from a time credit granted for caring for a disabled child. Specifically, collective labour agreement no. 103/4, recently concluded at the National Labour Council, has expanded the definition of a disabled child.

Current definition

Currently, in order to benefit from a time credit granted for the provision of care to a disabled child up to the age of 21, the worker must provide his or her employer with a certificate stating that the child suffers from a physical or mental disability of at least 66%, or from a condition that equates to at least 4 points attributed in Pillar 1 on the socio-medical scale within the meaning of the regulations concerning child benefits.

Expanded definition

The definition of a disabled child regarding entitlement to time credit will in the near future be expanded in order to take all the factors characterising a child’s disability into account.

A certificate stating that the child has a condition equating to at least 9 points attributed in the set of 3 pillars on the socio-medical scale within the meaning of the regulations concerning child benefits will also grant entitlement to a time credit for the provision of care to a disabled child up to the age of 21.

Date of entry into force

This amendment provided for in CLA no. 103/4 will apply to all requests (or requests for extension) for time credit submitted to the employer as from the date of entry into force of CLA no. 103/4.

CLA no. 103/4’s date of entry into force is not yet known. It will coincide with the date of entry into force of the Royal Decree (amending the Royal Decree of 12 December 2001), which will harmonise the rules on career break benefit entitlements with those applying to the entitlement to time credit (as provided for in CLA no. 103, amended by CLA no. 103/4).

In any event, CLA no. 103/4 will enter into force by 1 April 2018 at the latest.
