Posting employees in Belgium - The liaison person

Since 1 February 2018 the obligation to appoint a liaison person is extended to the sector of international transport and initial assembly and installation of goods.

Are you a foreign employer and do you want to post employees temporarily in Belgium? Then you must first submit a ‘Limosa’ posting declaration to the Belgian National Social Security Office (NSSO). Since 1 October 2017 you must also appoint a liaison person in Belgium before the start of the employment in Belgium.

In your capacity of Belgian company employing posted employees you, as an agent, can submit the ‘Limosa’ posting declaration. You have to appoint the liaison person via het posting declaration. Read our infoflash on the role of the liaison person.

Since 1 February 2018 the obligation to appoint a liaison person is extended. Yet, employers of the sector of international transport and initial assembly and installation of goods are exempted from submitting a ‘Limosa’ posting declaration. However, they are obliged to appoint a liaison person via a specific procedure.

New procedure from 1 February 2018: international transport and initial assembly / installation

Also when the ‘Limosa’ posting declaration is not compulsory, foreign employers of the following sectors must appoint a liaison person.

  • road transport of persons (JC 140, JC 140.01, not for JC 140.02), except for cabotage or transit;
  • road transport of goods (JC 140.03), except for cabotage or transit;
  • initial assembly and/or initial installation of goods for not more than 8 days (Limosa posting declaration compulsory from the 9th day)

What information must be provided? The identification and contact data of the liaison person: name, first names, date of birth, physical and electronic addresses, phone number and capacity of the liaison person.

How must this information be provided? The identification and contact data of the liaison person should be communicated

  • by e-mail to SPOC.LabourInspection@employment.belgium.be; or
  • by letter to: FPS Employment, Work and Social Dialogue, General Directorate of the Social Legislation, Central Administration, rue Ernest Blérot 1 in 1070 Brussels.

Do not forget to ask an A1 declaration

In case of an inspection, the A1 form is of crucial importance. It is a standard document that is delivered by the sending state and proves that the employee is subject to the social security of that state. The A1 form proves that the employee is exempt from Belgian social security contributions.

You must request the A1 form in the sending state.
