Joint Committee 126: extension of the scope to non-manual workers

Joint Committee (JC) 126 for upholstery and woodworking provides for an extension of its scope. From 1st April 2021 (date to be confirmed) JC 126 will be competent for both manual and non-manual workers.

A Royal Decree confirming this decision has yet to be signed.

What does this mean in practice?

Employers who employ non-manual workers and carry out activities falling within the scope of JC 126 will have to transfer their non-manual workers from JC 200 to JC 126.

For manual workers, nothing will change on 1st April 2021.

Which employers?

It is not always clear which activities fall within the scope of JC 126. The National Social Security Office (NSSO) makes a selection of the companies concerned on the basis of the NACE codes. This selection is done in collaboration with the social partners in JC 126, but the final decision is taken by the NSSO.

Transitional sectoral measures

The social partners are working on sectoral collective labour agreements (CLAs) which will define the transitional measures for non-manual workers. It is expected that these CLAs will maintain as much continuity as possible and will retain the benefits of JC 200 for the time being for those non-manual workers who make the switch.
