DB2P (2): The daily management of the database

The database for supplementary pensions was created on the basis of articles 305 and 306 of the Program Law (I) of 27 December 2006 (RD 28/12/2006).  The objectives and operation of this database have been further developed by other acts.

On 31 December 2014, the so-called transitional period will come to an end. We would like to take this opportunity to go into this new tool.

Firstly, it is the responsibility of the insurer or the pension fund in charge of the external funding of the commitment to enter the data with regard to a pension commitment in the DB2P.

Nevertheless, the employer, as an organizer of a pension commitment, has 3 obligations:

  • Providing the pension institution with the full information: the pension institution can only register data of which it disposes. Therefore it is the responsibility of the organizer, i.e. the employer, to provide the pension institution with the most comprehensive data available concerning the pension commitment in view.
  • Responding to the data registered in the DB2P: the second obligation of the employer is responding to the data registered in the DB2P by the pension institution in order to have these data corrected and/or completed, if necessary. If he fails to do so within a certain time limit (see below), the employer shall be deemed to validate the data provided by the pension institution. 
  • Registering the internally funded pension commitments: if this type of commitment still exists in the company, the employer will have to register it in the DB2P on 31 December 2014 at the very latest. However, these cases are rather exceptional since for salaried workers, currently only internally funded individual pension commitments exist that were concluded before 16 November 2003.

Declaration of a new commitment before 01/05/2013

The externally funded collective or individual commitment had to be declared by the pension institution from 1 January 2011 (private sector) or 1 January 2012 (public sector).

Insurer or pension fund

Not later than on 31 December 2014, the employer must comment on the structure of the pension commitment via the on-line application. If he fails to do so, the employer shall be deemed to agree to the data that the pension institution has registered in the DB2P.

Employer (organizer)

Declaration of a new commitment as from 01/05/2013 or amendment of an existing commitment (regardless of the date of the first registration).

The externally funded collective or individual commitment shall be declared not later than within 90 calendar days after the establishment of the commitment.

Insurer or pension fund

Within 90 calendar days after the declaration of the commitment by the pension institution, Sigedis npa requests the employer to comment on the structure of the pension commitments.

Upon the receipt of the request, the employer has 90 calendar days to give his comments. If he fails to do so, the employer shall be deemed to agree to the data that the pension institution has registered in the DB2P.

Employer (organizer)

Declaration of the premiums on 30 June of the year following the payment of the premiums at the very latest.

To be able to calculate the contributions due on the premiums that are paid to the pension institution, the latter must provide the information with regard to a contribution year not later than on 30 June of the following year.
