The Brussels Government is supporting the sectors of nightclubs, restaurants and cafés and their main suppliers, events, culture, tourism, sport and passenger transport by granting them a new bonus.
You can now apply for this bonus on-line up to 16 June 2022.
This 2022 recover bonus is the successor to the recover bonus that was available to these same sectors in October 2021 (see our Infoflash of 28 October 2021).
Do you qualify for the bonus?
General conditions to be met
To be eligible for this bonus, you must:
- be registered in the CBE on 31 December 2021;
- have an establishment unit in the Brussels-Capital Region on 31 December 2021;
- not benefit from the VAT exemption scheme for small enterprises;
- meet your social and tax obligations and comply with your obligations regarding the publication of your annual account with the National Bank of Belgium;
- meet your VAT obligations;
- have a Belgian current account;
- not have benefited from any Brussels aid for non-profit organisations in the socio-cultural sector;
- have had a turnover of more than 25,000 € in 2019 (only for companies that were registered with the CBE prior to 1 January 2019);
- not already have been experiencing difficulties on 31 December 2019 and, as a company, not already have received more than 2,300,000 € in aid, including this bonus, under the temporary framework for state aid;
- on 31 December 2021 carry out an activity falling under one of the NACE codes listed below.
Particular conditions
You must also meet certain conditions which vary according to your sector of activity.
Reca sector (= hospitality sector without hotels) and its suppliers
- You have one of the NACE codes listed in the annex.
- You meet your obligations with regard to the registered cash register system.
Nightclubs sector
- You are assigned NACE code 56.302 prior to 1 January 2022;
- You have an environmental permit or an environmental statement covering your activity as a nightclub issued no later than 31 December 2021.
What is the amount of the bonus?
The amount depends on the percentage of loss of turnover and the number of employees you employ (in FTEs).
The Brussels-Capital Region will use the 2019 social balance sheet to determine your number of employees (in FTEs). If you are not obliged to publish a social balance sheet or if the publication deadline has not yet expired, the Brussels administration will rely on a certificate issued by your payroll office showing the average number of employees in FTE for the year 2019.
The amount of the variable bonus cannot exceed the actual loss of turnover during the period concerned. The revenue loss is calculated by comparing the 2019 and 2021 reference periods.
The amount of turnover is calculated at the company level and not at the level of each establishment unit.
