Boris Johnson's Brexit deal was approved by the British House of Commons. This deal contains important measures paving the way for Britain leaving the European Union on 31 January 2020. What are the consequences for your companies and your employees?
In order to facilitate the transition, the Brexit deal includes a transition period until 31 December 2020. During this period, the British will continue to apply European law to the EEA nationals who carry out activities in their country and European law will continue to apply to British nationals living and working, for example, in Belgium.
Until 31 December 2020: European social security legislation will however continue to apply in full. Therefore, nothing changes to the social security situation of Belgian citizens in the United Kingdom and vice versa. During the posting period, your Belgian employees do not need a work permit or a single permit.
From 1 January 2021: European legislation will no longer apply. However, certain social security rights (including posting) continue to be guaranteed for UK and European citizens who exercised the right of free movement of persons before 31 December 2020. A new system will have to be worked out for new postings.
